2. General rules
2.1.These “General Terms and Conditions” – hereinafter referred to as “GTC” – regulate the conditions
of using the accommodation facilities of the Kira Pension operated by the Service Provider at 6,
Berzsenyi utca, 8693 Lengyeltóti, and the related services provided by the Service Provider.
2.2 These GTC do not preclude the Service Provider from concluding a separate agreement in relation
to the services it offers, the specific provisions of which may differ from these provisions.
3. The contracting party
3.1 The contracting party is the natural person, legal entity or unincorporated business entity ordering
or using the services of the Service Provider. The contracting party is also the natural person who
actually uses the Service Provider’s services. The person ordering and/or using the services is
hereinafter collectively referred to as the “Guest”.
3.2 The Service Provider and the Customer shall become parties to the Service Agreement, hereinafter
collectively referred to as the “Parties”, as applicable, upon fulfilment of the conditions.
4. Establishment of the service contract, booking procedure, modification of the booking
4.1 The Service Provider shall send the Guest an offer within 36 hours of receipt of the request for an
offer, either verbally (in person, by telephone) or in writing (by letter, fax, e-mail, online). If the actual
order is not received in writing from the Guest within 36 hours of the offer being sent, the Service
Provider shall be released from its obligation to make an offer and the Service Provider’s obligation to
make an offer shall cease.

4.2 The service contract is concluded upon the written confirmation of the order placed by the Guest
– order – by the Service Provider, and with regard to this written confirmation, the order is considered
a contract concluded in writing. The verbal order and/or order modification shall only be deemed to
constitute a contractual obligation if it has been confirmed in writing by the Service Provider, the verbal
confirmation of the order or order modification shall not constitute a contractual obligation.
4.3 The contract for the use of the service is for a limited period.
4.4 In the event that the Customer decides before the expiry of the fixed term not to use the service
until the expiry of the fixed term, the Customer is still obliged to pay the full price of the service to the
Service Provider and the Service Provider is entitled to claim the full price of the ordered service. The
Service Provider shall be entitled to resell the room abandoned by the Guest before the expiry of the
fixed period.
4.5 The Guest is entitled to extend the service only if the Service Provider agrees to this before the
expiry of the fixed term.
4.6 The service contract may only be amended with the written joint will of the contracting parties.
5. The cancellation conditions
5.1 If the Guest does not arrive or does not cancel his/her order by the due date, he/she shall pay a
penalty, the amount of which shall be the total amount of the ordered service. In case of cancellation
or failure to cancel, regardless of the payment of the penalty, the Service Provider’s obligation to
provide accommodation shall cease and the Service Provider shall be entitled to rent the unused room
to another guest.
5.2 General cancellation conditions: cancellation is free of charge 22 days before the arrival date.
Cancellation within 21-15 days before the arrival date issubject to a penalty of 30% of the total booking
amount, cancellation within 14-8 days before the arrival date is subject to a penalty of 60% of the total
booking amount, cancellation within 7 days before the arrival date is subject to a penalty of 100% of
the total booking amount. Exceptions are reservations that have been fixed in the cancellation policy
of the accommodation portals contracted with the Service Provider, under the conditions described
therein.
5.3 In the case of individual and promotional offers, the cancellation conditions will be subject to the
terms and conditions set out in the offer. The discounts of time-limited offers apply to the entire
content and duration of the package, and cannot be interrupted or shortened. Should such a request
nevertheless arise, the Service Provider will request the full price of the package.
5.4. The Service Provider will deduct the advance payment from the amount of the penalty.
6. Prices applied by the Service Provider
6.1 The room rates of the pension are available at the reception desk, the rates of other services
provided by the Service Provider other than accommodation services are available in the respective
sections of the pension and on the website of the pension, but they are also available upon request at
the reception desk.
6.2 The Service Provider shall be free to change its prices at any time without prior notice, provided,
of course, that this shall not apply to prices already offered by the Service Provider in its price offer at
the request of the Contracting Party.
6.3 The Service Provider is entitled to set its prices in Hungarian forints and in any convertible currency.
6.4. The Service Provider undertakes to publish its current room rates, promotions, discounts and other
offers on the website www. kirapanzio.hu.
7. Discounts
7.1 The Service Provider offers discounts to Guests who arrive with children under 5 years of age. The
amount of the discount is indicated on the website of the Pension.
7.2 The Service Provider shall display information about any discounts other than the permanent
discounts specified in clause 7.1 on the Pension’s website.
8. Method of payment and its guarantee
8.1 The Service Provider shall indicate the total amount of the ordered services, calculated for the
whole stay, on the written confirmation sent to the Guest.
8.2 The Service Provider shall have the right to request an advance payment from the Guest, the
amount of which shall be specified in the confirmation. The fixed amount must be paid by a given
deadline. The prepared advance invoice will be delivered on the spot but will be sent by e-mail upon
request. In the event of cancellation, the Service Provider will treat the paid deposit according to the
cancellation conditions.
8.3 The Service Provider shall charge the Guest’s consumption in the catering units of the
Guesthouse to the Guest’s room account or the Guest may pay in cash in the catering unit.
8.4 The Guest shall be entitled and obliged to pay the consideration for the Service in Hungarian
forints and/or in any currency of his choice, which the Service Provider has announced for
acceptance in the notice placed at the reception and/or on the website www. kirapanzio.hu.
8.5 The Guest is obliged to pay the amount due for the stay at the Pension and the
services/consumed products used during the stay at the latest before his/her final departure from
the Hotel.
8.7 In the event of unpaid departure and/or damages incurred during the check-out of the rooms
after departure, the Guesthouse will, in addition to reporting the matter to the police, pursue its
claim against the Guest through legal action, the costs of which will be borne by the Guest.
8.8 The Service Provider shall not be liable for any loss or damage arising from the use of any
payment instrument

9. How and under what conditions to use the service
9.1 Guests will receive a card upon arrival, which requires the registration of the guest(s) staying in the
room. Registration involves the accurate completion of the registration form and proof of the Guest’s
identity. The presentation of the identification document is a contractual condition considered
essential for the Pension. In the case of stateless persons and non-EU citizens, the presentation and
handing over of a stateless card or passport is required by law.
9.2 The Guest may reserve the room ordered and confirmed by the Service Provider from 14:00 on the
day of arrival (check-in).
9.3 In the event that the Guest wishes to occupy the room prior to the check-in time specified in clause
9.2 on the day of arrival, he/she may do so for an additional charge, subject to availability and in prior
agreement with the Service Provider.
9.4. The guest must check out of the room with his/her luggage and belongings by 10:00 a.m. on the
day of check-out and return the card received at check-in to the
at reception.
9.5 In the event that the Guest wishes to leave the room after the check-out time specified in clause
9.4 on the day of departure, he/she may do so for an additional charge, subject to availability and
subject to prior agreement with the Service Provider.
9.6 The accommodation does not accept pets.
9.7 The Service Provider is entitled to terminate the accommodation contract with immediate effect
or refuse to provide the service if:
a) the Guest does not make proper use of the room provided to him/her, or does not make proper use
of the services provided by the Service Provider and/or the premises used for their provision;
b) the Guest disturbs the peace and quiet of the Guest House and does not stop the disturbing
behaviour despite being asked to do so;
c) the Guest fails to comply with the safety rules of the Pension (e.g. smoking in a prohibited place and
does not stop smoking despite being told to do so);
d) the Guest behaves in an inappropriate or rude manner with the employees or Guests of the Guest
House, is under the influence of alcohol or drugs, or engages in threatening, abusive or other
unacceptable behaviour;
e) the Guest is infectious or suffers from a disease that disturbs the peace and quiet of other Guests;
9.8 The Guest uses all services of the Pension at his/her own risk during the entire stay.
9.9 Only Guests registered at the reception desk are allowed to stay in the rooms of the Pension. The
Guest shall be responsible for the conduct of his/her visitor, including any damage caused. Liability for
any damage caused by the Guest to the Guest and/or third parties is excluded. The guesthouse may
charge an extra fee for any guest exceeding the number of guests stated in the reservation.
9.10. Children under the age of 14 may only stay in the room under the constant supervision of a parent
or other person of legal capacity authorised by the parent. The person accompanying the child is
responsible for the child’s safety and for any damage caused by the child. Guests under the age of 14
may use the services of the pension only if accompanied by a parent or other person of legal capacity
authorised by the parent or parent. No alcohol may be consumed on the premises of the guesthouse
by persons under 18 years of age. The parent of a person under 18 years of age or a person of legal
capacity authorised by him/her must ensure that this obligation is observed/fulfilled. The parent or
person with legal capacity authorised by the parent shall be fully responsible for the legal, moral and
financial consequences of any breach of this obligation.
10. Rights of the Guest
10.1. Under the contract, the Guest is entitled to use the room ordered and the facilities of the
accommodation which are included in the normal scope of services, and
are not covered by the special conditions.
10.2 The Guest may lodge a complaint regarding the performance of the services provided by the
Service Provider. The Service Provider undertakes to investigate the complaint submitted to it in
writing or orally at its reception and recorded in the minutes within 72 hours of receipt of the complaint
and to provide the Guest with a substantive response.
11. Obligations of the Guest
11.1 The Guest is obliged to pay the Service Provider for the services ordered in the contract no laterthan the time and in the manner specified in the contract.
11.2 The Guest is obliged to ensure that minors under his/her supervision remain under adult
supervision at all times in the Service Provider’s hotel.
11.3 The Guest shall immediately report any damage suffered by him/her to the Pension’s reception
desk and provide the Pension with all necessary information required to clarify the circumstances of
the damage or to initiate any infringement or criminal proceedings.
11.4. The Guest is not allowed to bring his/her own food and drink to the Service Provider’s catering
units.
11.5. The furnishings and equipment of the Bed and Breakfast may be removed from the premises of
the Bed and Breakfast only with the prior written consent of the Bed and Breakfast. Any rearrangement
of the guest room or moving of furniture may only be carried out by a member of the staff of the guest
house or a person appointed by the guest house.
11.6 Only the iron and coffee maker provided by the hotel may be used in the guest rooms. The pension
excludes any liability for damage caused to items brought in without permission.
12. The Guest’s liability for damages
12.1 The Guest shall be liable for any damage caused by the Service Provider or a third party to theGuest, the Guest’s companion or persons under the supervision of any of these persons.
12.2 The Guest’s obligation to compensate for damages shall also apply if the injured party is entitled
to claim compensation for damages directly from the Service Provider.
12.3 The Guest shall be fully liable for any damage or injury caused by the unauthorised entry to other
guests, third parties or the hotel.
12.4 Guests will be given a card at the front door of the bed and breakfast upon arrival. In case of loss,
a fee of 10.000 HUF will be charged.
13. Rights of the Service Provider
13.1 If the Guest does not fulfil his/her obligation to pay the fees for the services used or ordered butnot used, the Service Provider shall be entitled to a lien on the property of the Guest which he/she has
brought with him/her to the hotel to secure his/her claims.
13.2 Various programmes are organised in the Pension for the entertainment of the Guests. These
programmes may be photographed and videotaped by the Pension staff or by a company appointed
by the Pension for marketing and promotional purposes. The Guest attending the programmes
acknowledges and expressly agrees that any such images may be used in publications and advertising.
The Pension shall publish these images in such a way that the Guest is not clearly recognisable and
identifiable, taking into account the requirements of data protection and privacy rights.
14. Obligations of the Service Provider
14.1 The Service Provider shall provide the accommodation and other services ordered under thecontract in accordance with the applicable regulations and service standards.
14.2 The Service Provider shall investigate the written complaint of the Guest and take the necessary
steps to solve the problem, record the steps taken in writing and inform the Guest thereof.
15. Liability of the Service Provider for damages
15.1 The Service Provider shall be liable for any damage suffered by the Guest which is caused by thefault of the Service Provider or its employees within the hotel.
15.2 The Service Provider shall not be liable for damages caused by any cause beyond the control of
the Service Provider’s employees and Guests, or caused by the Guest or persons under the Guest’s
supervision.
15.3 The Service Provider reserves the right to designate a place(s) within the hotel where the Guest
may not enter. The Service Provider shall clearly mark such places. The Supplier shall not be liable for
any damage caused to the Guest or persons under the Guest’s supervision in the place(s) where the
Guest is not allowed to enter.
15.4 The Service Provider shall only be liable for damages if it is reported to the Service Provider’s
reception desk immediately after the damage has occurred, with the necessary information.
15.5 In case of cash, securities, valuables, the Service Provider is only obliged to compensate the
damage caused if the guest places them in the safe at the reception.
15.6 The Service Provider is only liable for damage to other items brought in by the Guest if the damage
occurred in a place normally used by the Guest or open to the Guest.
15.7 The Service Provider shall be liable for any damage incurred up to the amount of the daily room
rate paid by the Guest.
15.8 The Service Provider’s liability does not extend to the contracting party’s luggage and its contents
on arrival and departure, during loading and unloading, and during transportation to and from the
room.
16. Illness or death of the Guest
16.1 In the event that the Guest falls ill during the period of using the accommodation or service andthe Service Provider becomes aware of this, the Service Provider shall offer the Guest medical
assistance, with the costs of the offered and accepted medical assistance being borne by the Guest. If
the doctor diagnoses a contagious disease, the Service Provider is entitled to refuse further service.
Any additional costs incurred due to early departure from the Guest House shall be borne by the Guest.
16.2 In the event of the illness or death of the Guest, the Service Provider shall be entitled to
compensation from the relatives or heirs of the sick or deceased person, up to the amount of any
medical expenses advanced by the Service Provider, the value of the services used prior to the death
and the damage caused to the property of the Service Provider and/or its Guests in connection with
the illness or death. The death of the Guest shall be deemed by the Service Provider to be the death
of the Guest before the expiry of the term of the contract and, in this case, the Service Provider shall
not be entitled to refund the fee for the remaining part of the contractual term to the legal heir or
heirs.
17. Vis maior
17.1 Any cause or circumstance (e.g. war, fire, flood, adverse weather conditions, power failure, strike,etc.) over which neither the Service Provider, the Guest nor the Contracting Party has control – force
majeure – shall release either party from the performance of its obligations under the contract for as
long as such cause or circumstance exists. The contracting parties agree to use their best endeavours
to minimise the possibility of such causes or circumstances occurring and to remedy any damage or
delay caused thereby as soon as possible.
18. Law applicable to the relationship between the parties and the competent court
In matters not regulated in these GTC, the provisions of Hungarian law, in particular the Civil Code,shall prevail. The contracting parties shall attempt to settle any legal disputes by means of an out-ofcourt settlement. If this does not lead to a result, the contracting parties stipulate the exclusive
jurisdiction of the court of the Service Provider’s domicile
